Sounds scary, but in truth, it&#8217;s a very simple and necessary thing in place to protect the estate, the heirs, and even you as the executor against any unfortunate financial events. <\/span><span style=\"font-weight: 400;\">Suppose your loved one has died, and you\u2019ve been chosen as the executor of their estate. You\u2019re still in the throes of handling the loss, and divorce, and the court dumps a list of duties on you, like paying debts, distributing assets, filing paperwork, and then throws a curveball: \u201cYou\u2019ll want to post a probate bond, too.\u201d<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-3479 size-full\" A probate bond is just a promise that if the executor doesn\u2019t handle the money properly, he or she doesn\u2019t steal it, and doesn\u2019t make expensive mistakes with it, the people who are supposed to get the pain and the suffering in the will won\u2019t be left without.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Who_Needs_a_Probate_Bond\"><\/span><span style=\"font-weight: 400;\">Who Needs a Probate Bond?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Not all of those involved in probate require a bond, but courts often demand one when extra oversight is necessary. Let\u2019s examine the most common roles:<\/span><\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Executors or Personal Representatives<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If you\u2019re named in a will as the executor, you will be in charge of collecting assets, paying debts and doling out what\u2019s left to the heirs. And because this position will require you to deal with money and property, courts may have to take a guarantee from you in the form of a probate bonds\u2014especially if the estate will owe federal or state death taxes, or if your state\u2019s probate structure says that you must be bonded.<\/span><\/p>\n<ol start=\"2\">\n<li><span style=\"font-weight: 400;\"> Court-Appointed Administrators<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">When someone dies without a will which is called intestate, the court will appoint an administrator to manage the estate. Since there\u2019s no will expressing the deceased\u2019s wishes, the courts often require a bond just to ensure the administrator will act fairly and lawfully.<\/span><\/p>\n<ol start=\"3\">\n<li><span style=\"font-weight: 400;\"> Guardians or Conservators<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If you\u2019re appointed to manage the finances of a minor child or an incapacitated adult, a probate bond may be required. This ensures that the vulnerable person\u2019s money is protected from any\u00a0 misuse.<\/span><\/p>\n<ol start=\"4\">\n<li><span style=\"font-weight: 400;\"> Trustees (in Some States)<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">Some states require trustees overseeing certain probate-related trusts to post a bond but this is not always the case.<\/span><\/p>\n<ol start=\"5\">\n<li><span style=\"font-weight: 400;\"> Out-of-State Executors<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">If you live in a different state than where the probate is taking place, many courts will automatically require a bond. Here are the most common:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The will doesn\u2019t waive the bond requirement. Some wills will explicitly state \u201cno bond required.\u201d If yours doesn\u2019t, then the default may be that a bond is necessary.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There\u2019s no will (intestate estates). Attorneys, accountants, or trust companies who act as executors may already carry bonds that satisfy the court.<\/span><\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"How_Probate_Bonds_Work\"><\/span><span style=\"font-weight: 400;\">How Probate Bonds Work<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Now that you know who needs them, let\u2019s talk about how probate bonds actually function.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A probate bond involves three parties:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Principal, that\u2019s you, the executor or administrator.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Obligee, the court requiring the bond.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Surety, the bonding company that issues the bond.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Here\u2019s the process in action:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You will apply for a bond through a surety company.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Then the company evaluates your credit and background before issuing the bond.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If you mishandle any estate funds, beneficiaries can file a claim against the bond.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The surety company will pay out valid claims but then comes after you personally for reimbursement.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In other words, the bond doesn\u2019t necessarily let you off the hook. Instead, it ensures there\u2019s money available to cover losses while holding you accountable.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"What_Happens_If_You_Dont_Get_One\"><\/span><span style=\"font-weight: 400;\">What Happens If You Don\u2019t Get One?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Skipping a probate bond isn\u2019t really an option if the court will require it. Here\u2019s what could happen if ever you don\u2019t secure one:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Delay or denial of your appointment. The court won\u2019t finalize your role as executor until the bond is in place.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Risk of disputes. But I detailed how in fact that bond not only protects her, but protects her every bit as much as it does the estate. The bond gave her brother peace of mind that if Leo had done anything wrong, the estate would be made whole.
